The access rights granted to you under this Agreement cannot be transferred without the explicit written permission of the owner of Vital Infusions. You are responsible for the actions of any other person who may utilize your access rights on the Services.

Please read this Agreement carefully before accessing or using the Services. By accessing or using any part of the Services, you agree to be bound by the terms and conditions of this Agreement. If you do not agree to all the terms and conditions of this Agreement, then you must leave the Services and you may not use any services of Vital Infusions. If these terms and conditions are considered an offer by Vital Infusions, acceptance is expressly limited to these terms.

The Services are designed to enable you to request intravenous hydration services provided by a licensed medical professional. A healthcare professional will be responsible for delivering healthcare services to you. Once you have made your selection, the Services will send a message to the professional inquiring whether they are available to provide you with the requested healthcare services. If a healthcare professional agrees to provide you with healthcare services, our medical team will schedule those services and handle the billing.
THE SERVICES ARE AVAILABLE ONLY TO INDIVIDUALS WHO ARE AT LEAST 21 YEARS OLD.

Fees, Payment, and Refunds
By scheduling an appointment with Vital Infusions, you agree to pay Vital Infusions the specified fee for the scheduled service. Payments will be charged at the time of scheduling or at the time of service, as indicated or directed. Vital Infusions requires a minimum of 24-hour advanced notice for cancellations. If you cancel an appointment within 24 hours of the scheduled time, you will be charged the full amount of the service fee. However, you may cancel an appointment without charge if it is done within ten (10) minutes of being scheduled through the Services or otherwise. Missed appointments are non-refundable. In the rare event that we are unable to provide our services to you due to our availability, a credit or refund will be issued. However, credits or refunds will not be provided to customers who are unsatisfied with the services received.

If Vital Infusions is unable to complete the portion of the scheduled service(s) following the insertion of the I.V. needle due to circumstances beyond their control (e.g., the I.V. drip does not start after attempts), you will receive a credit or refund for the full amount of the scheduled services, minus a medical assessment fee of one hundred dollars ($100.00).

In the event that you provide false information about yourself, including but not limited to your age, or if the medical history you provided is determined to be inaccurate by a medical professional engaged by Vital Infusions at the time of the appointment, or if you are under the influence of drugs or alcohol during the appointment, you will be charged for the full amount of the scheduled services, but no services will be provided. However, for an additional charge of one hundred dollars ($100.00), you may reschedule the appointment for a time that is at least four (4) hours after the original scheduled time, provided you are no longer under the influence of drugs or alcohol and your medical history has been corrected, as determined by a medical professional engaged by Vital Infusions.

By accepting these terms and completing your purchase, you authorize Vital Infusions to automatically charge your credit card (or other payment methods) for the applicable fees or charges, including any necessary taxes.

If you make a payment by credit card, your credit card will be processed through Stripe for the purpose of payment processing. If you choose to modify the scheduled and/or purchased services from Vital Infusions before their delivery, Vital Infusions may, at its sole discretion, use your stored credit card information to charge you for additional services provided or issue a credit for services not provided. You authorize Vital Infusions to make such charges or credits. In the case of a credit, it will be applied approximately two (2) to three (3) business days after notifying Vital Infusions of the service charge, subject to the policies of the respective credit card companies. You acknowledge that it is your responsibility to ensure advance payment for all scheduled and/or purchased services from Vital Infusions and to ensure that your credit cards or other accepted payment instruments remain valid and sufficient for such purposes.

Gift Certificates, Packages, and Gift Cards
Gift certificates purchased from Vital Infusions are non-refundable. They are valid for a period of one (1) year from the date of issuance. Gift certificates cannot be used in conjunction with promotional codes. The remaining balance on a gift card cannot be exchanged for cash or another voucher. If the cost of the redeemed services exceeds the value of the gift certificate, the redeemer is responsible for paying the additional amount. Gift certificates will be considered void and invalid if the Expiry Date, Authorized Signature, seal, or other authentication signs are missing, altered, or tampered with. Lost, damaged, or stolen gift certificates will not be replaced. The gift certificate can only be redeemed with Vital Infusions. Vital Infusions reserves the right to modify these terms and conditions without prior notice.
General Disclaimer
The Services provided by Vital Infusions offer information about health issues with the intention of assisting users in making informed decisions. However, it is important to note that medical information is distinct from medical advice. As the user of the Services, you assume full responsibility and risk for any use of the Services, including the information presented. The Services are intended as a general information resource only and should not be considered a substitute for professional medical advice or treatment. It is your responsibility to seek professional medical advice if you have any questions about your health or a specific health condition. By using the Services, you agree to indemnify and hold Vital Infusions and its affiliates harmless from any claims, damages, causes of action, judgments, liabilities, expenses, and demands of any kind relating to your use of the Services, including any reliance on the information provided.

You acknowledge that your use of the Services provided by Vital Infusions is at your own risk. Vital Infusions will not be held liable for any harm to you or others resulting from the use of the Services, including any treatments and products provided through the Services or otherwise. Vital Infusions does not make any claims, representations, or warranties regarding your fitness after receiving services, including but not limited to your ability to drive a vehicle or operate machinery. It is important to note that you may require assistance or accompaniment after receiving services until you feel capable of resuming normal activities.

Vital Infusions does not endorse, recommend, or encourage excessive alcohol consumption. Excessive drinking can have serious negative effects on your health and well-being, leading to irreversible diseases such as alcoholism, cirrhosis of the liver, and cancer. Please drink responsibly. While the Services may provide information related to certain medical conditions and their management, if you have a medical condition, it is important to promptly consult your own physician or healthcare provider.

Site Modifications
Vital Infusions reserves the right to modify or replace any part of this Agreement at its sole discretion and without prior notice. It is your responsibility to regularly review this Agreement for any changes. Your continued access to or use of the Services after any modifications to this Agreement constitutes your acceptance of those changes. By using our services, you agree to be bound by the most current version of the Terms of Use, including any revisions. In the future, Vital Infusions may introduce new services which will also be subject to the terms and conditions outlined in this Agreement.

Termination
Vital Infusions may terminate your access to the services, either in part or in its entirety, at any time and for any reason, with or without notice, and the termination will be effective immediately. If you wish to terminate this Agreement, you can do so by discontinuing your use of services. Vital Infusions also reserves the right to terminate the services immediately as part of a general shutdown or for any other lawful reason. Upon termination, all provisions of this Agreement that are meant to survive termination will continue to apply, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

Limitation of Liability
In addition to any limitations of liability provided by applicable law or this Agreement, Vital Infusions, its suppliers, licensors, and individuals associated with Vital Infusions, including their respective equity owners, will not be liable for any special, incidental, or consequential damages arising out of or related to this Agreement, including but not limited to damages resulting from the contract, negligence, strict liability, or other legal or equitable theory. However, this limitation of liability shall not apply to the extent prohibited by applicable law.

Indemnification
You agree to indemnify, defend, and hold harmless Vital Infusions, its contractors, licensors, and their respective directors, officers, employees, and agents from and against any and all claims, damages, causes of action, judgments, liabilities, demands, and expenses, including attorneys' fees, arising out of your use of the Services or any violation of this Agreement.

Applicable Law and Jurisdiction
Any suit, action, or proceeding between you and Vital Infusions arising from or in connection with this Agreement (referred to as a "Judicial Action") will be governed by the laws of the state where the registered Administrative Contact resides (referred to as the "Admin State"). This choice of law applies to agreements between residents of the Admin State and is applied to agreements entered into and performed entirely within the Admin State. You consent to the jurisdiction of federal and state courts within the Admin State and agree to the venue of any Judicial Action brought against you for breaches of this Agreement. Furthermore, you consent to electronic service of process regarding any Judicial Action under this Agreement.

Records of Visitor Use and Abuse.

VISITORS AGREE THAT HARVESTING, GATHERING, STORING, TRANSFERRING TO A THIRD PARTY, OR SENDING ANY MESSAGE(S) TO THE IDENTIFIER CONSTITUTES AN ACCEPTANCE AND SUBSEQUENT BREACH OF THIS AGREEMENT.
